Terms and Conditions for FarmNav

Welcome to FarmNav, a service provided by RAINDROP LLC ("us", "we", or "our"). Our app (the "Service") displays guidance lines for field work, showing you how far you are from your next pass and what ground you have already covered, through an auto-renewing subscription.

1. ACCEPTANCE OF TERMS

By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you do not have permission to access the Service.

2. SUBSCRIPTION LICENSE

2.1 Scope of License

You are granted a non-exclusive, non-transferable license to use the Service for your personal or business field-work purposes, on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

2.2 Subscription

FarmNav requires an active subscription.

- Price: $29.99 per year (United States pricing; your local price is shown in the app before you subscribe).

- Free trial: New subscribers are offered a 7-day free trial. If you have already used a trial on your Apple Account, the app will show you the price without a trial.

- Auto-renewal: Your subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends. Your Apple Account is charged for renewal within 24 hours before the period ends.

- Managing your subscription: View, change, or cancel your subscription at any time in your Apple Account settings. Cancelling stops future renewals; it does not shorten the period you have already paid for.

- Restoring a purchase: If you reinstall the app or move to a new device, use "Restore Purchases" on the subscription screen to restore access on the same Apple Account.

2.3 Restrictions

You may not resell, redistribute, or sublicense the Service or any part of it. You may not modify, reverse engineer, or create derivative works of the Service.

3. REFUNDS

Subscriptions to FarmNav are purchased through the App Store, and refunds are issued by Apple rather than by us. To request a refund, use Apple's "Report a Problem" page at https://reportaproblem.apple.com or contact Apple Support.

If something has gone wrong with the app, write to us at help@raindrop.farm. We would rather fix it, and we are happy to support a refund request to Apple.

4. SAFETY AND ACCURACY

Please read this section. It describes what FarmNav is and, just as importantly, what it is not.

4.1 FarmNav does not steer your machine

FarmNav displays guidance on a screen. It does not steer, drive, control, or connect to any vehicle, implement, or machine, and it has no autosteer capability of any kind. Every input to your machine comes from you.

4.2 Accuracy is limited

FarmNav uses the satellite positioning built into your phone or tablet. In good conditions this is typically accurate to within about 3 to 5 metres (roughly 10 to 16 feet). It is not RTK and does not provide RTK-level or sub-inch precision. Accuracy degrades, sometimes substantially and without warning, under tree canopy, near buildings or machinery, in valleys, in poor weather, and anywhere the view of the sky is obstructed. Positioning may also be interrupted or unavailable entirely.

The app shows its current accuracy estimate on screen. Treat that number as information about how much to trust the guidance.

4.3 You remain responsible

You are solely responsible for the safe operation of your machine at all times. This includes watching the field rather than the screen, avoiding people, livestock, obstacles, hazards, and field boundaries, and complying with all laws and regulations that apply to your operation.

Do not rely on FarmNav for any purpose where an error could cause injury, damage, or loss. Do not interact with your device in a way that is unsafe while your machine is moving. If the guidance on screen disagrees with what you can see out of the window, believe the window.

5. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time, or that the guidance, position, heading, area, or coverage information it displays will be accurate or complete.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, RAINDROP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, crops, yield, or data, arising out of or in connection with your use of the Service. This includes, without limitation, overlapped or skipped passes, misapplied seed, fertiliser, or chemical, crop loss or damage, damage to equipment or property, and fuel or time wasted.

To the maximum extent permitted by law, our total liability for any claim relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

7. USER DATA

FarmNav keeps your location and your field data on your device. Our handling of data is described in our Privacy Policy, available at https://raindrop.farm/farmnav/privacy

8. NON-PERSONAL DATA COLLECTION

The FarmNav app does not use cookies and collects no non-personal data beyond what is described in our Privacy Policy.

9. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are and will remain the exclusive property of RAINDROP LLC and its licensors. The fields, jobs, and other data you create using the Service remain yours.

10. APPLE APP STORE TERMS

The following terms apply because FarmNav is distributed through the Apple App Store:

10.1 These Terms are between you and RAINDROP LLC only, and not with Apple. Apple is not responsible for the Service or its content.

10.2 Scope of license. Your license to use the Service is as set out in Section 2 above and is limited to a non-transferable license to use FarmNav on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

10.3 Maintenance and support. RAINDROP LLC is solely responsible for providing maintenance and support for the Service. Apple has no obligation whatsoever to furnish any maintenance or support services.

10.4 Warranty. RAINDROP LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

10.5 Product claims. RAINDROP LLC, not Apple, is responsible for addressing any claims relating to the Service, including product liability claims, any claim that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

10.6 Intellectual property claims. In the event of any third-party claim that the Service infringes that third party's intellectual property rights, RAINDROP LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

10.7 Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

10.8 Developer contact. Questions, complaints, and claims regarding the Service should be directed to RAINDROP LLC at help@raindrop.farm

10.9 Third-party terms. You must comply with any applicable third-party terms of agreement when using the Service.

10.10 Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
